Landlord’s legal process for removing a tenant from the property is called an eviction or in some states an unlawful detainer action

Eviction laws are governed by state law. An eviction in one state may be called an unlawful detainer. Some states refer to the process as an eviction action.

No matter what a landlord calls the process, eviction usually means the tenant has stopped paying the rent.

The landlord must go through the state court’s legal power to order law enforcement to remove the tenant from the premise. The landlord must follow a very specific process, such as properly serving a notice to quit.

In a fixed-term lease, the landlord must prove they have the legal right to break the lease and demand the tenant return possession to the landlord.
