Eviction of tenant during a lease with a fixed term

A lease is for a fixed length of time and is binding on both parties. The lease legally requires the tenant to pay the rent on time, and the landlord is legally required to provide you with a habitable premise for the term of the lease. Sometimes a fixed-term lease can turn into a month-to-month lease depending on the language of the lease and whether the tenant is considered a holdover. In either case, an eviction defense lawyer should be consulted.

The landlord cannot evict before the lease expires without legal cause. Even if the landlord has found a renter for your unit at a rental rate substantially higher than what you are currently paying.
