Separate property is the undivided separate property of one spouse

Separate property is the opposite of marital property – sometimes called community property.

Specifically, separate property includes property owned before the marriage or acquired during the marriage by gift, inheritance, or bequest to only one spouse.

Sometimes, the separate property of one spouse can be transmuted into the community property of both spouses through the commingling of assets, particularly when the spouses open joint checking and saving accounts.
