Restitution – Distinguishing Civil From Criminal Context

Criminal Context

In the criminal justice system, restitution is a court-ordered payment made by an offender to a victim for losses resulting from the crime. Courts typically determine the amount of restitution during sentencing, and failure to pay can lead to additional legal consequences for the offender.

Civil Context

In civil law, restitution refers to restoring a party to its original position before a contract was entered into or the wrongful act occurred. Restitution often involves compensating for services rendered or benefits conferred unjustly.
