Many jurisdictions prefer giving sole legal custody to one of the two parents and giving joint physical custody to both parents. However, it is not unusual to see both parents awarded joint legal and physical custody but with one home serving as the children’s primary residence.
Joint physical custody
Unless there are physical or emotional parental abuse issues, courts prefer to award joint physical custody to both parents. The courts believe that the children’s best interests are served by ensuring they have sufficient and regular contact with both parents.
