In divorce law, equitable distribution is a legal principle used in many jurisdictions to divide marital property based on equity and fairness rather than a strictly equal split among the divorcing spouses

Note: In determining what is fair and equitable, the courts will often consider:

  • Each spouse’s contribution to the marital estate
  • Each spouse’s economic circumstances
  • Each spouse’s physical and mental health
  • The child custody arrangement
  • Waste of marital assets by one spouse
  • Marital misconduct
