A court will usually look to whether the idea for the commission of the criminal act originated with the defendant or with law enforcement.
Entrapment Has Two Essential Elements That Must Be Proved:
- First, the defendant must prove that law enforcement did something to induce the defendant to do the crime.
- Second, the defendant must prove that he lacked the intention, nor was he predisposed to commit the crime.
