A person fleeing from their country of origin must first be admitted as a refugee
To qualify as a refugee, a person must prove they escaped from their country of origin and seeks asylum in another country. A refugee seeking asylum must prove that they have a well-founded fear of being persecuted or facing imminent danger or will be returning to a humanitarian crisis.
The most common forms of persecution are based on the refugee’s race, political beliefs, religious beliefs, or membership in political groups adverse to their country of origin’s political interests.
U.S. Refugee Visa Admissions Program
The refugee process also requires a qualified referral. Once the referral is issued, the program will determine if the refugee meets certain conditions to be considered for refugee status.
Once determined to be eligible for a refugee visa, U.S. law requires the refugee to apply for a green card twelve months from arrival.
