In civil and criminal trials all questions of fact are almost always determined by the jury

A jury is legally obligated to decide all questions of fact in a jury trial. The judge decides all questions of law.

If the trial does not include a jury, the judge will decide all questions of law and facts in a given case. The latter is called a court trial, and the former is a jury trial.
