The legal right to appeal a lower court ruling
An appeal is a formal legal brief sent to the appellate court, requesting that the court review the trial court’s ruling. There are criminal appeals and criminal appeals.
The appellant must present a specific question of law for the appellate court to review. The appeal must submit a question of law, not of fact.
If the appellate court determines a legal error was made at the trial court, it can reverse or remand the case back to the trial court with its findings and instructions.
