Tenant has the legal right to inspect the premises for preexisting damage and other conditions that need to be repaired or replaced by the landlord before taking occupancy

Tenant’s Inspection should include:

  • The tenant should carefully inspect the floor, ceiling, and walls, including signs of mildew, mold, and leaks.
  • Other areas of concern include checking the water pressure and ensuring the hot and cold water operate correctly.
  • Also, ensure the water drains work properly in the showers, baths, and sinks. Open and close windows to ensure they’re not stuck, and look the appliances over carefully.
  • Prepare a written list of all the conditions you believe need repair or things that are already damaged, and ask the landlord to make the list an addendum to your lease. This will ensure the landlord is legally aware of what needs repair and what preexisting damage was present before you moved into the apartment.
  • Taking pictures or a video of the apartment’s condition is also a good idea.
