Homeowners are legally responsible if a person is injured on their property resulting from the homeowner’s active or passive negligence

As a homeowner, one has the legal duty to exercise reasonable care in keeping their property safe and to warn against any known danger.

In most cases, so long as the homeowner takes reasonable care in the inspection, maintenance, and upkeep of their property and can prove it, they stand a good chance of defeating a lawsuit should they be sued for injuries sustained on their property.

If the landowner knows that young children are on the property, in most states, the landowner is legally obligated to protect and warn the children even if the danger is obvious such as children playing near a barb-wired fence.
